Which mortgage origination costs can you claim?
According to the repeated rulings of the Supreme Court, abusive clauses that transfer the entirety of origination costs to the consumer are null and void. You are entitled to recover the following payments:
- Notary fees: 50% of the notary invoice generated by the mortgage loan deed.
- Land Registry fees: 100% of the Land Registry costs.
- Administrative agency fees: 100% of the fees charged by the administrative agency imposed by the financial institution.
- Appraisal costs: 100% of the appraisal, plus the property verification costs.
- Arrangement fee: Fully claimable if the bank fails to prove that said charge corresponds to real, effective services actually requested by the client.
Tax note: It is important to clarify that the Stamp Duty (AJD) arising from property transfers falls on the borrower, as ruled by the Supreme Court. This tax is therefore not subject to claim, and our strategy focuses exclusively on viable items to avoid any surprises.
